Although derived from hemp, THC-O is technically analogous to a Schedule I drug and could itself be a Schedule I drug based on the Federal Analogue Act of 1986. However, as long as its supply chain can be traced back to federally legal hemp, THC-O is in enough gray area to slip under the regulatory radar, at least for now.
